The truck cartel - secret price fixing by leading manufacturers

On 19 July 2016, the European Commission imposed fines on leading truck manufacturers Daimler, Volvo/Renault, Iveco, MAN and DAF (the "cartel members"). These manufacturers were found guilty of, through impermissible price fixing, having formed a cartel between 1997 and 2011 for medium and heavy trucks. On 27 September 2017, the European Commission also found that Scania had participated in the cartel and imposed a fine.

Based on a study commissioned by the European Commission some time ago, on average, international cartels resulted in damages in the amount of 20% of the purchase price. The exact damages must be determined by a recognised and reputable competition economist.

Existing lawsuits against the truck cartel

Lawsuit I against the truck cartel



The first lawsuit was filed in 2017 and comprises over 3,000 mandates with almost 80,000 vehicles. This action was dismissed in the first instance at Munich Regional Court I at the beginning of 2020. The court based its dismissal on the fact that it considered a litigation-financed bundling of claims to be a violation of the German Legal Services Act. The plaintiff subsequently appealed to the Munich Higher Regional Court. In October 2023, the oral hearing took place at the Munich Higher Regional Court. Following the BGH's decision in June 2022 in financialright proceedings against Volkswagen in connection with the diesel emissions scandal, in which the BGH declared class actions admissible, we are optimistic, as the BGH's ruling invalidates virtually all the grounds for the previous dismissal of the action.


Lawsuit II against the truck cartel


The second lawsuit against the truck cartel was filed at the end of 2018 and expanded by over 35,000 trucks at the beginning of 2020, meaning that almost 6,500 companies with a total of over 90,000 trucks are represented by the plaintiff in this lawsuit. The first hearing took place at Munich Regional Court I in October 2022, which was successful. At the hearing, the judge declared the action admissible and followed the opinion of the BGH in his statements. The next hearing has not yet been scheduled.
